A BILL expiring funds to the department of tax and revenue, lottery
commission, revenue and transfers fund, fund 7202,
organization 0705, for the fiscal year ending the thirtieth
day of June, two thousand two, in the amount of one hundred
three thousand eight hundred four dollars and forty-one cents
from the department of education and the arts - board of
trustees of the university system of west virginia and board
of directors of the state college system - central office -
control account - lottery education fund, fund 4057, fiscal
year 2001, organization 0452, activity 867, and making a
supplementary appropriation of lottery net profits from the
balance of moneys remaining as an unappropriated balance in
lottery net profits to the higher education policy commission - lottery education - higher education policy commission -
control account, fund 4925, fiscal year 2002, organization
0441, all supplementing and amending the appropriation for the
fiscal year ending the thirtieth day of June, two thousand
two.



Whereas, the Legislature finds that the account balance in the
department of education and the arts - board of trustees of the
university system of west virginia and board of directors of the
state college system - central office - control account - lottery
education fund, fund 4057, fiscal year 2001, organization 0452,
activity 867, exceeds that which is necessary for the purpose for
which the account was established; and



Whereas, by the provisions of this legislation, there now
remains an unappropriated balance in lottery net profits which is
available for appropriation during the fiscal year ending the
thirtieth day of June, two thousand two; therefore
Be it enacted by the Legislature of West Virginia:



That the balance of funds in the department of education and
the arts - board of trustees of the university system of west
virginia and board of directors of the state college system -
central office - control account - lottery education fund, fund
4057, fiscal year 2001, organization 0452, activity 867, be decreased by expiring the amount of one hundred three thousand
eight hundred four dollars and forty-one cents to the department of
tax and revenue, lottery commission, revenue and transfers fund,
fund 7202, fiscal year 2002, organization 0705, and that the total
appropriation for the fiscal year ending the thirtieth day of June,
two thousand two, to fund 4925, fiscal year 2002, organization
0441, be supplemented and amended by increasing the total
appropriation by one hundred three thousand eight hundred four
dollars as follows:

The purpose of this bill is to expire the sum of one hundred
three thousand eight hundred four dollars and forty-one cents from
the department of education and the arts - board of trustees of the university system of west virginia and board of directors of the
state college system - central office - control account - lottery
education fund, fund 4057, fiscal year 2001, organization 0452,
activity 867, to the balance of the department of tax and revenue,
lottery commission - revenue and transfers fund, fund 7202,
organization 0705, for the fiscal year ending the thirtieth day of
June, two thousand two, to be available for expenditure during the
fiscal year two thousand two, and to supplement the higher
education policy commission - lottery education - higher education
policy commission - control account, fund 4925, fiscal year 2002,
organization 0441, in the budget act for the fiscal year ending the
thirtieth day of June, two thousand two, by increasing the existing
appropriation for HEAPS Grant Program by one hundred three thousand
eight hundred four dollars for expenditure during fiscal year two
thousand two.
